ENDS Compliance Checklist: Questions to Ask Before Listing a Product

Before an adult-market business lists a vape product, it should confirm more than a product name and image. Role, documentation, market rules and age controls all matter.

A product listing can look complete while leaving out the questions that create the greatest operational risk. For an adult-market vaping business, a good pre-listing review begins with the company’s role. A retailer, importer, distributor, manufacturer and online marketplace may have different responsibilities, even when they handle the same product.

Identify the role before reviewing the paperwork

Ask what your business is actually doing with the product in the target market. Are you selling at retail, importing, relabelling, assembling, modifying or manufacturing? The answer affects the rules that may apply. In the United States, the FDA regulates the manufacture, import, packaging, labeling, advertising, promotion, sale and distribution of ENDS and relevant components. This is not a reason to treat one country’s system as universal; it is a reminder to identify the local regulatory framework first.

Build a product file, not a loose folder

Keep the commercial and technical documents that support a listing together. Depending on the market and role, that may include supplier details, product identifiers, specifications, compatibility information, label artwork, instructions, relevant notifications or authorisation evidence, and records of age-restriction controls. The exact document list is jurisdiction-specific. A file should make it easy to answer a reasonable question from a regulator, distributor or customer service team.

Check the listing itself

Review the product title, image, description and claims. They should accurately reflect the supplied documentation and avoid health, cessation, safety or environmental promises that cannot be substantiated. A product page should be adult-focused and should not use imagery or language that may appeal to minors. When specifications are included, use the manufacturer’s stated information rather than making estimates appear certain.

Confirm the sale pathway

The product may be documented correctly but still be presented through a weak sales flow. Verify age controls, shipping restrictions, marketplace policies and customer-support handling. For business customers, confirm that regional distribution arrangements and any required registrations have been reviewed before inventory is committed.

Make compliance a review cycle

A listing should not be “approved forever.” Assign an owner, record the decision date and schedule a review when rules, suppliers, packaging or product components change. A modest recurring process is more dependable than a last-minute check during a launch.
